Justin Timberlake's character Frankie is based on Jesse Rugge, who was convicted alongside Jesse James Hollywood in connection with the real-life murder of Nick Markowitz, the case on which the film is based. Rugge was paroled in 2013, to the horror of the Markowitz family and Governor Brown. The character Elvis, played by Shawn Hatosy, is based on Ryan Hoyt, the man Jesse James Hollywood hired to kill Nick Markowitz.

During a scene in which their characters fight, Sharon Stone hit Ben Foster so hard that his nose started bleeding. She told him to do it because the scene needed to be as realistic as possible.

Filming had actually been completed before Jesse James Hollywood was found and arrested in Brazil in 2005. When Nick Cassavetes heard the news of the arrest, he brought the entire crew back to shoot the new ending shown in the film.
