    In the scene where Jim (Christian Bale) and Mike (Freddy Rodríguez) visit Darrell (Terry Crews), after shooting the scripted scene they realized they still had the location for two hours and began improvising. They ended up with a thirty-minute scene in which the three characters talk about their lives. According to Bale, it was one of the funniest experiences of his career.

    According to David Ayer, the screenplay for Harsh Times (2005) was written in 1996, shortly after he wrote the screenplay for Training Day (2001), which he had completed a year earlier. The script is semi-autobiographical and based on his own experiences. Like the character Jim (Christian Bale), Ayer grew up in South Central Los Angeles and joined the army. After returning to Los Angeles, he too found himself drifting into petty crime and hanging out with a friend all day. He managed to pull his life together, but some of his friends did not. Jim's character is therefore a combination of Ayer and several people he knew.

    David Ayer first met Christian Bale when Bale auditioned for the role in Training Day (2001) that ultimately went to Ethan Hawke. Ayer liked Bale's intensity and gave him the Harsh Times screenplay. Bale liked the film, and Ayer promised him that if the film were made, he could play Jim. When the film went into production, Ayer kept his word.

Ayer had initially sold the screenplay to another company, but they demanded changes he was unwilling to make. To help establish the bond between them, they wanted several flashback scenes of Jim (Christian Bale) and Mike (Freddy Rodríguez) as children, less profanity, and also wanted the ending changed so that Jim survives and pulls his life back together. Ayer refused to make the changes and bought the screenplay back.

Bale initially wanted to take the full Ranger's School course, which lasts eight weeks and has a 70% dropout rate, but because the shooting schedule did not allow him enough time, he was instead put through an intensive one-week course.
